• The AI-powered Instagram content analysis services
• All related services provided by AskHook

AskHook may update these Terms at any time. When changes materially affect your rights, we’ll aim to give at least 30 days' notice. The latest version on the Website always applies.

By accessing or using the Services, you confirm that you have read and agree to these Terms.
The Services are for business use only and not available to individuals under 18.

• Service(s): AskHook’s website, tools, analytics, chat assistant, and all features (web app only).
• Subscription Plan: Any available plan tier with defined quotas and features.
• User Content: Instagram profiles or assets selected for analysis.
• Website: askhook.com and all subdomains.

Article 2 — Service Description & Scope

2.1 Platform Purpose
AI-powered analysis of public Instagram content for insights, trends, and performance data.

2.2 Service Offerings
Includes:

• Instagram public data scraping
• Video analysis
• AI chat assistant
• Performance analytics
• Data visualization
• Creative brief + storyboard generation

(Web application only; no mobile app or public API.)

2.3 Subscription Tiers
Free, Starter, Creator, Growth, Enterprise — each with specific quotas and features.

2.4 Geographic Availability
Global, except where restricted by law or technical limitations.

Article 3 — User Account & Registration

3.1 Eligibility
Must be 18+ and legally able to enter into a binding agreement.

3.2 Account Creation
You must provide accurate and updated information. Login may be via email/password or third-party authentication.

3.3 Account Responsibility
You’re responsible for safeguarding credentials and all activity under your account.

3.4 Account Termination

• By You: Can terminate anytime via settings or support.
• By AskHook: May suspend or terminate for policy violations, misuse, non-payment, legal requirements, or security risks.

Article 4 — Acceptable Use Policy

4.1 Permitted Use
Analysis of publicly available Instagram content for business purposes.

4.2 Prohibited Activities
You may not:

• Analyze private Instagram accounts without explicit permission
• Exceed plan quotas through bulk scraping
• Reverse-engineer the platform
• Share your login credentials
• Use the platform for unlawful or harmful purposes
• Violate Instagram policies
• Upload illegal or offensive content
• Introduce malware
• Build competing products with insights from the Service

4.3 Content Responsibility
You must ensure you have rights to analyze the content you submit.

4.4 Rate Limits
Usage is subject to your plan’s quotas. Enforcement may include automatic blocking when limits are reached.

Article 5 — Subscription Plans & Financial Terms

5.1 Plans & Features
Subscription tiers are described on askhook.com.

5.2 Free Trials
Paid plans may include a 7-day trial. If not cancelled, your plan becomes paid automatically.

5.3 Billing & Payment

• Recurring billing (monthly/annual)
• Processed by third-party payment providers
• Taxes applied where required

5.4 Price Changes
Advance notice (typically 30 days) will be provided.

5.5 Failed Payments
We may retry payment; persistent failure can lead to suspension.

5.6 Overage Charges
Applies to Enterprise plans if usage exceeds agreed limits.

5.7 Cancellation
You may cancel anytime; access continues until end of billing cycle.

5.8 Refunds
No refunds after trial period ends or for unused time/features.

Article 6 — Termination

6.1 By You
You may close your account at any time.

6.2 By AskHook
Immediate termination may occur if you:

• Breach Terms
• Fail payments
• Violate acceptable use
• Harm the platform or users
• Trigger legal or regulatory obligations
• Are affected by service discontinuation

6.3 Effects of Termination

• Access ends immediately
• Outstanding payments still owed
• Data handled per Privacy Policy
• Anonymized data may be retained
• Certain clauses survive termination

Article 7 — Data Collection, Use & Privacy

7.1 Instagram Data
Public Instagram data is collected using in-house systems and third-party providers.

7.2 Personal Information
Handled per our Privacy Policy.

7.3 AI Analysis Data
May be anonymized and used to improve algorithms.

7.4 Chat Data
Stored for 90 days on paid plans; not stored on Free plans.

7.5 Third-Party Tools
Used for scraping, auth, payments, analytics, and support.

Article 8 — Intellectual Property Rights

AskHook retains all IP rights over the platform, algorithms, and technology.

• User Content: You own it; you grant AskHook permission to process it for service delivery.
• AI Analysis Results: Licensed for your internal business use; you don’t own the underlying methodology.
• Third-Party Content: Instagram content is owned by creators and Instagram.
• Export: No data export function is provided.
• Feedback: AskHook may use suggestions freely.

Article 9 — Service Availability & Performance

• Uptime target: 99% (not guaranteed)
• Maintenance: Notice given when possible
• Rate limits: Dependent on Instagram and third-party data providers
• Processing times: May vary
• Feature changes: May occur without liability

Article 10 — AI Analysis Disclaimers

• AI output may contain errors
• Provided for informational purposes
• Not financial, legal, or marketing advice
• English optimized; other languages may vary

Article 11 — Third-Party Integrations

Not responsible for changes or failures caused by Instagram or third-party tools.

Article 12 — Limitation of Liability

• Services provided as is
• No liability for indirect or consequential damages
• Total liability capped at $500 or the amount paid in the previous 12 months
• Not liable for Instagram policy changes or business decisions based on insights
• Mandatory legal exceptions still apply

Article 13 — User-Generated Content & Sharing

If sharing public analysis links:

• You are fully responsible for what you share
• AskHook may remove inappropriate shared content

Article 14 — Indemnification

You indemnify AskHook against claims arising from:

• Your use of the Service
• Your breach of Terms
• Content you analyze or share

Article 15 — Compliance & Legal Requirements

Includes GDPR compliance, age restrictions, international laws, and data portability limitations.

Article 16 — Instagram Policies

You must comply with Instagram’s terms.
AI may not be used for unethical or discriminatory purposes.

Article 17 — Support

• Support via in-app tools or email
• No guaranteed SLA unless Enterprise-specific
• Bugs and issues should be reported promptly

Article 18 — Changes to Terms

We may modify these Terms at any time.
Notices may be sent via email, Website, or in-app notifications.

Article 19 — Dispute Resolution & Governing Law

• Governed by English law
• Courts of England and Wales have exclusive jurisdiction
• Users must attempt amicable resolution first
• No class actions permitted

Article 20 — Miscellaneous

Includes entire agreement clause, severability, force majeure, notices, assignment, and contractor status.
